AN ACT

To amend chapter 660, RSMo, relating to the department of social services by adding thereto one new section relating to nonemergency medical transportation programs.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 660, RSMo, is amended by adding thereto one new section, to be known as section 660.027, to read as follows:

660.027. 1. Any driver who provides services for any nonemergency medical transportation program receiving state or federal funding shall:

(1) Possess a valid Missouri class E chauffeur's license;

(2) Have no prior class A, B or C felony convictions;

(3) Know safety procedures for the type of service provided, such as loading, unloading and transporting passengers with various physical impairments or disabilities;

(4) Use and maintain any specialized equipment necessary for the type of service provided, such as equipment used for the transportation of persons with special needs, including, but not limited to, use of tie-downs for wheelchairs; and

(5) Maintain a no-smoking policy while providing transportation services.

2. In addition to the requirements of subsection 1 of this section, the department of social services shall promulgate rules and regulations to establish standards for drivers and vehicles used in the federal nonemergency medical transportation program administered by the division of medical services.

3. No rule or portion of a rule promulgated pursuant to the authority of this section shall become effective unless it has been promulgated pursuant to the provisions of chapter 536, RSMo.
