AN ACT
To amend chapters 197 and 488, RSMo, by adding thereto two new sections relating to the trauma center fund.
Section A. Chapters 197 and 488, RSMo, are amended by adding thereto two new sections, to be known as sections 197.800 and 488.5345, to read as follows:
197.800. 1. There is hereby established a "Trauma Center Fund" in the state treasury. All moneys collected pursuant to section 488.5345, RSMo, shall be deposited in the fund. The state treasurer, in consultation with the department of health, shall distribute the moneys in the fund on a quarterly basis to designated trauma centers in an amount calculated pursuant to subsection 2 of this section.
2. The moneys in the fund shall be allocated proportionately to each trauma region so that the trauma region receives the moneys collected from within its region for any violation of law listed in section 488.5345, RSMo. The distribution to trauma centers shall be a payment per trauma case, including cases where the trauma center provides initial trauma care only, and shall be made to all qualifying trauma centers within each trauma region. The amount of payment to each trauma center shall be calculated by dividing the moneys from the trauma center fund that are allocated to a specific trauma region by the total number of trauma cases in that trauma region for the most recently completed state fiscal year. The result of such calculation shall be the amount of the trauma payment to be paid to qualifying trauma centers for each trauma case. No moneys shall be distributed to a trauma center located outside the state.
3. The department of health shall provide the state treasurer with all information necessary for the state treasurer to distribute the quarterly payments to trauma centers in accordance with this section, including, but not limited to, a listing of all qualifying trauma centers, a listing of the regions of the state and every trauma center located in each region, and the total number of trauma cases for each trauma region.
4. The department of health shall receive up to one and one-half percent of the moneys in the trauma fund to defray the administrative costs associated with providing the information required in subsection 3 of this section to the state treasurer. The state treasurer may retain up to one percent of the moneys in the trauma center fund to defray the cost of administering the distributions.
5. Notwithstanding the provisions of section 33.080, RSMo, to the contrary, the moneys in the trauma center fund shall not revert to the credit of the general revenue fund at the end of the biennium.
488.5345. 1. In addition to any other fines or court costs assessed by the courts, any person who is found guilty or enters a plea of guilty or nolo contendere to an intoxication-related traffic offense, as defined in section 577.023, RSMo, or any weapons offense pursuant to chapter 571, RSMo, shall pay a court cost of twenty-five dollars to the clerk of the court. Such cost, less two and one-half percent which shall be used to defray the administrative costs incurred by the clerk, shall be remitted to the state treasurer within sixty days after receipt for deposit in the trauma center fund established in section 197.800, RSMo. Such court cost shall not be considered a part of the fine imposed by the court for purposes of any reduction in such fine.
2. No later than March first of each year, the circuit clerk shall submit a report on the amount of court costs
remitted to the state treasurer pursuant to section 197.800, RSMo, during the preceding calendar
year.
