AN ACT
To amend chapter 393, RSMo, relating to gas, water, electric and sewer companies by adding thereto two new sections relating to rates for certain services provided by water companies.
Section A. Chapter 393, RSMo, is amended by adding thereto two new sections, to be known as sections 393.285 and 393.287, to read as follows:
393.285. 1. Beginning August 28, 2000, and ending December 31, 2000, the public service commission shall not allow any increase in the rate charged for private fire service by any water corporation subject to its jurisdiction. Beginning January 1, 2001, and at subsequent two-year intervals pursuant to subsection 2 of this section, the commission shall review the private fire service provided by each water corporation during the two years prior to the review, to determine if any incident requiring a significant use of water supplied by the corporation for private fire service occurred during that time period. If no such incident occurred, then that corporation shall not charge any private fire service rate, beginning on the date of such determination by the commission. If any such incident did occur, not including frozen pipes or breaks, unless the water corporation can prove substantial use of water because of such hardships, then the corporation may charge its current rate for private fire service for two years from the date of such incident.
2. The initial review of each water corporation pursuant to subsection 1 of this section shall be done as soon as is practicable after January 1, 2001. The subsequent review of each water corporation pursuant to subsection 1 of this section shall be done:
(1) Two years from the date of the prior review, if no incident was determined to have occurred pursuant to the prior review; or
(2) Two years from the date of the incident, if an incident was determined to have occurred pursuant to the prior review.
393.287. No water corporation subject to the jurisdiction of the public service commission shall charge more than
one fee for connection of water services to any one location unless sixty days have passed between the connection
service rendered to the previous customer and the connection service rendered to the subsequent
customer.
