AN ACT
To amend chapter 301, RSMo, relating to regulation and licensing of motor vehicles by adding thereto one new section relating to back-up devices for trucks.
Section A. Chapter 301, RSMo, is amended by adding thereto one new section, to be known as section 301.335, to read as follows:
301.335. 1. In addition to any other law, rule or regulation regarding mirrors or other safety devices on motor vehicles, every truck registered in this state or permanently garaged, for insurance purposes, in this state that is equipped with a cube-style, walk-in cargo box up to twenty-six feet long used in the commercial delivery of goods and services shall be equipped with an automated or electronic back-up device to alert the driver that a person or object is behind the truck. All back-up devices required by this section shall be maintained in good condition. Rear back-up devices shall be of a type approved by the state highway patrol and the department of revenue, division of motor vehicle and drivers licensing.
2. Approved devices pursuant to this section shall:
(1) Not consist solely of mirrors or mirror systems when such systems are not used in conjunction with other approved automated or electronic devices;
(2) Possess the capability to detect and audibly and visually signal the driver of nonsolid objects or obstructions rearward of the vehicle, including but not limited to chain-link fences, wire obstructions or other objects;
(3) Operate consistently in all climatic conditions and shall not be susceptible to interference or ineffective operation as a result of ice, snow, rain, dust or direct sunlight;
(4) Possess the capability of activation and thereby alerting personnel near the backing vehicle, via triggering of audible exterior back-up warning devices;
(5) Not require the driver to divert his or her attention from, or in any way encumber, normal backing procedures. Devices which require the driver to look away from reflected images in rear-view mirrors shall, for purposes of this subdivision, be considered devices which divert or encumber a driver; and
(6) First be approved by the Federal Communications Commission and be issued a Certificate of Equipment Authorization for general use by the public.
3. No rule or portion of a rule promulgated pursuant to this section shall take effect unless such rule has been
promulgated pursuant to chapter 536, RSMo.
