AN ACT
To repeal section 198.401, RSMo Supp. 1999, relating to nursing facility reimbursement allowance, and to enact in lieu thereof one new section relating to the same subject.
Section A. Section 198.401, RSMo Supp. 1999, is repealed and one new section enacted in lieu thereof, to be known as section 198.401, to read as follows:
198.401. 1. Each nursing facility, except for state-owned and -operated facilities, and facilities that do not have a Medicaid provider agreement with the department, shall, in addition to all other fees and taxes now required or paid, pay a nursing facility reimbursement allowance for the privilege of engaging in the business of providing nursing facility services, other than services in an institution for mental diseases, in this state.
2. For the purpose of this section, the phrase "engaging in the business of providing nursing facility services, other than services in an institution for mental diseases, in this state" means accepting payment for such services.
3. For the purpose of this section, the term "nursing facility" shall be defined using the definition in section 1396r, Title
42 United States Code, as amended, and as such qualifies as a class of health care providers recognized in federal Public
Law 102-234 Medicaid Voluntary Contribution and Provider Specific Tax Amendment of 1991.
