HB 202 -- TRANSPORTATION DISTRICTS SPONSOR: Rizzo COMMITTEE ACTION: Voted "do pass by consent" by the Committee on Transportation by a vote of 20 to 0. This bill allows all property owners in a transportation development district to cast their ballot by unanimous petition approving any measure submitted to them as voters, if all owners joined in the petition for formation of the district. When a procedure is used where no eligible registered voters reside within a district, the court may call a meeting for the purpose of electing directors without publication, if all real property owners joined in the petition for formation of the district. The sales tax for a transportation district may be imposed in increments of one-eighth of one percent up to a maximum of one and one-half percent on all retail receipts. Currently, the sales tax may be imposed in increments of one-eighth of one percent, one-fourth of one percent, three-eights of one percent, one-half of one percent, or one percent. FISCAL NOTE: Income to the Department of Revenue from 1% collection fee is $0 to Unknown in FY 2002, FY 2003, and FY 2004. PROPONENTS: Supporters say that under current law when a development is in an area owned by one person the process is cumbersome, costly, and time consuming. Testifying for the bill were Representative Rizzo; Earthstone, Inc.; Red Capital; and Parkway Development-Kansas City, Missouri. OPPONENTS: There was no opposition voiced to the committee.
