HB 209 -- CONTROLLED SUBSTANCES CO-SPONSORS: Hosmer, Williams, McKenna, Kennedy, Ward, Bray, Boucher, Relford, Jolly COMMITTEE ACTION: Voted "do pass by consent" by the Committee on Criminal Law by a vote of 11 to 0. This bill makes changes to laws concerning controlled substances. The bill: (1) Makes gamma hydroxybutyric acid (GHB) a Schedule I controlled substance, except in circumstances where GHB or its derivatives have been approved for medical use, in which case it is a Schedule III controlled substance. The bill also makes ketamine and its derivatives a Schedule III controlled substance and removes it from the list of Schedule IV substances; (2) Adds gamma butyrolactone and 1,4 butanediol to the list of drugs for which a report is required to the Department of Health upon all transactions; and (3) Removes certain timing and data requirements from the reports that must be made to the department concerning controlled substance transactions, but requires record-keeping that meets federal and state department standards. The bill authorizes the department to inspect the establishments of those who transact controlled substances. FISCAL NOTE: Estimated Net Cost to General Revenue Fund of less than $100,000 in FY 2002, FY 2003, and FY 2004. PROPONENTS: Supporters say that the bill would ensure that the "date rape" drug is classified as a controlled substance. The bill is also necessary to reclassify the drug ketamine in accordance with federal law and to adopt new record-keeping regulations in accordance with federal law.
