HB 45 -- COMMISSIONER OF EDUCATION

COMMITTEE ACTION: Voted "do pass by consent" by the Committee
on Education-Elementary and Secondary by a vote of 23 to 0.
Current law requires the Commissioner of Education to be a
resident of the state for at least one year prior to
appointment. This bill deletes the one year residency
requirement and requires instead that the commissioner be a
state resident upon assumption of the duties of commissioner.
FISCAL NOTE: No impact on state funds.
PROPONENTS: Supporters say that the bill is good public
policy. The strict letter of the current law would preclude the
search for an out-of-state candidate or else require that an
out-of-state candidate be hired on an "acting" basis for a year
until the residency requirement could be met.
Testifying for the bill was Representative Farnen.
OPPONENTS: There was no opposition voiced to the committee.
