HB 728, HCA 1 -- PUBLIC WATER AND SEWER SUPPLY SPONSOR: Hoppe COMMITTEE ACTION: Voted "do pass" by the Committee on Local Government and Related Matters by a vote of 17 to 0. This bill prohibits public water supply districts from purchasing the assets of any regulated water or sewer corporation without the approval of the Public Service Commission and the water or sewer corporation. After purchasing the water or sewer corporation, a public water supply district may serve any location that received service from the water or sewer corporation, even those outside of the district's geographical boundary lines, and may provide new water or sewer services to any area within one-fourth of a mile of real property served by the water or sewer corporation prior to the purchase. The bill also modifies the definition of the term "joint contract" to mean a contract entered into among contracting municipalities or between municipalities and public water supply districts or sewer districts for the purpose of establishing a commission. In current law, joint contract means a contract entered into between municipalities, public water supply districts, sewer districts, or nonprofit water companies. HCA 1 -- Allows any municipality to contract with a private or public water company to terminate water service when a customer fails to pay for municipal sewer services. FISCAL NOTE: No impact on state funds. PROPONENTS: Supporters say that the bill corrects an error in last year's legislation.
