Summary of the Committee Version of the Bill

HB 796 -- LABELING OF DRUGS AND DEVICES

SPONSOR:  Hosmer

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee
on Children, Families and Health by a vote of 10 to 0.

This bill revises a provision pertaining to the labeling of
drugs and devices.  The bill requires manufacturers, packers,
distributors, and sellers of drugs and devices in Missouri to
comply with the current federal labeling requirements contained
in the Federal Food, Drug and Cosmetic Act and any federal
regulations created under the act.  Drugs and devices which
contain labeling not in compliance with the bill will be deemed
misbranded.

The bill repeals the current state standards for considering a
drug or device misbranded.

FISCAL NOTE:  No impact on state funds.

PROPONENTS:  Supporters say that drug manufacturers have to
label drugs according to federal laws, not state law.
Supporters also state that the bill would eliminate duplication
between the federal and state laws on the labeling of drugs and
devices.

Testifying for the bill were Representative Hosmer; and
Department of Health.

OPPONENTS:  There was no opposition voiced to the committee.
