HB 265 -- First Degree Murder Sentencing Procedure

Sponsor:  Hosmer

This bill allows triers of fact to impose sentences of life
imprisonment without the possibility of parole against
defendants convicted of first degree murder when the trier finds
by a preponderance of the evidence that the defendant is
mentally retarded, as defined in the bill.
