Summary of the Introduced Bill

HB 394 -- St. Louis Police Department

This bill revises provisions pertaining to the Board of Police
Commissioners of the City of St. Louis.  The board is required
to establish rules which allow the board or the chairman of the
board to delegate responsibility to conduct investigations or
hearings on matters pertaining to any section of Chapter 84,
RSMo, to a member of the board or to a hearing officer
designated by the board.  The duties and powers of the hearing
officer are contained in the bill.  Hearing officers are
prohibited from making final decisions and orders.

Following the completion of a hearing, the individual board
member or hearing officer is required to prepare a summary of
the hearing and recommend findings of fact, conclusions of law,
a decision, and an appropriate order for approval by the board.

The board may adopt the recommendations in whole or in part,
modify or reject such recommendations, require the production of
additional testimony, reassign the case for rehearing, or
conduct a new or additional hearing as necessary prior to
rendering a final decision.

Section 84.150, pertaining to the number of officers in each
rank, is repealed and a new section is added which allows the
board to appoint the number of officers needed in the rank of
lieutenant colonel (Assistant Police Chief) and below.  The
number of officers appointed in these various ranks will be
based on the board's determination of the number necessary to
provide adequate supervision and to fulfill the board's duties
and responsibilities.
