Summary of the Introduced Bill

HB 759 -- Child Relocation

Co-Sponsors: Kelly (27), Campbell, Smith, Riback Wilson (25),
Ostmann, Ross, Bray

This bill repeals the current child relocation statute in its
entirety and, with minor changes, reenacts the statute as it was
prior to the 1998 rewrite of the section.

The bill prohibits a custodial party from changing the residence
of a child to another state or removing the child from Missouri
for more than 90 days without a court order or written consent
of other parties with custody or visitation rights. Except
where good cause is shown, a noncustodial parent with visitation
rights must be given notice. Violations of court orders under
this section can be deemed a change in circumstances justifying
a child custody modification.
