Summary of the Introduced Bill

HB 923 -- Public Water Supply Districts

Co-Sponsors:  Wiggins, Relford, Hegeman, Mays (50), Griesheimer

This bill makes changes to laws governing public water supply
districts.  The bill:

(1)  Clarifies notice requirements and other procedural
requirements when districts seek to expand;

(2)  Allows water districts to distribute proceeds from the sale
or dissolution to water users on a pro rata basis if there are
no outstanding general obligation bonds.  Under current law, all
property owners would receive proceeds even if they had never
used and paid for district services;

(3)  Limits the permission requirement and payment to debt
related to areas that may be detached from a district.  Under
current law, districts are required to obtain permission from
creditors and cities are required to pay for all district debt
over $25,000 before territory can be detached from the district;

(4)  Repeals language allowing Franklin County to remove itself
from the district; and

(5)  Allows either a district or a municipality, if they cannot
reach an agreement, to request that the Public Service
Commission determine the fair value of district property within
an annexed area to be conveyed to the municipality.
