Summary of the Introduced Bill

HB 974 -- Genetic Information

Co-Sponsors:  Levin, Holt, Moore, Foley, Kelly (27), Scott,
Reid, Abel

This bill makes several changes in the law governing the use of
genetic information.  The bill prohibits:

(1)  The use of genetic information in the issuance of health
insurance policies;

(2)  Employers from requiring genetic tests or otherwise
obtaining any genetic information on employees or prospective
employees; and

(3)  The unauthorized disclosure of genetic information by
anyone who has access to this information in the ordinary course
of business.

Violators can be held liable for civil damages or equitable
relief.

The bill also makes it a class A misdemeanor to request someone
to submit to fingerprinting, retina scan, voice print analysis,
or DNA testing.  The bill provides exceptions for law
enforcement, membership to the Missouri Bar, use by financial
institutions, or any other use specifically provided by law.  A
court may impose a civil penalty of up to $100,000 upon a
business entity found in violation.
