Summary of the Perfected Version of the Bill

HCS HB 428 -- ELUDING A LAW ENFORCEMENT OFFICIAL (Kelly, 36)

This substitute creates the crime of eluding a law enforcement
official.  A person commits the crime if the person attempts to
elude a law enforcement official who has a reasonable suspicion
that a law or local ordinance has been violated by ignoring
visible and audible signs from a law enforcement official
directing the person to stop.  The penalty for the crime of
eluding a law enforcement official is a class D felony when the
person eludes a law enforcement official by operating a motor
vehicle in a way that poses a substantial risk of serious bodily
injury or death to any other person.  All other cases of eluding
a law enforcement official are class A misdemeanors.

FISCAL NOTE:  Cost to General Revenue Fund of less than $100,000
in FY 2002, FY 2003, and FY 2004.
