AN ACT
To amend chapter 267, RSMo, by adding thereto one new section relating to free roaming wild elk, with a penalty provision and an emergency clause.
Section A. Chapter 267, RSMo, is amended by adding thereto one new section, to be known as section 267.750, to read as follows:
267.750. 1. Prior to January 1, 2012, no person or governmental entity shall release elk into the wild in the state of Missouri.
2. Any person or entity who intentionally or through gross negligence releases elk into the wild in violation of this section is guilty of a class A misdemeanor.
Section B. Because immediate action is necessary to prevent the spread of disease in this state section A of this act is
deemed necessary for the immediate preservation of the public health, welfare, peace and safety, and is hereby declared to
be an emergency act within the meaning of the constitution, and section A of this act shall be in full force and effect upon
its passage and approval.
