AN ACT

To amend chapter 393, RSMo, by adding thereto one new section relating to regulation of natural gas suppliers.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 393, RSMo, is amended by adding thereto one new section, to be known as section 393.1050, to read as follows:

393.1050. 1. Any entity that supplies natural gas to a gas corporation regulated by the public service commission pursuant to chapter 386, RSMo, and this chapter shall, prior to January 1, 2002, or prior to its initial sale of natural gas to a gas corporation in this state, whichever later occurs, be certified by the public service commission as an authorized natural gas supplier. Initial certification shall be granted to all applicants, provided that they agree to supply the documentation required in subdivision (1) of this subsection. In order to achieve and maintain certification pursuant to this section, natural gas suppliers shall:

(1) Agree to submit documentation which itemizes the costs, profits or other uses to which the moneys paid to the natural gas supplier by the gas corporation for the natural gas are being put. Such documentation shall express such uses in terms of percentages, and shall include, but not be limited to, an expression of the percentage of profit earned by the natural gas supplier from such sales. The natural gas supplier shall present such information on the prior calendar year by March first of the subsequent year, beginning with the submission of an initial report by March 1, 2002, for any entity supplying natural gas in this state in the calendar year 2001; and

(2) For any calendar year beginning with the year 2002, as shown on such supplier's report due by March 1, 2003, not have earned a percentage of profit for sales supplying natural gas to gas corporations in this state in the previous calendar year which exceeds the maximum percentage of profit allowed for gas corporations in this state by the public service commission. In the event that a natural gas supplier violates the provisions of this subdivision, such supplier shall be put on probationary status by the commission for the following calendar year. If the natural gas supplier violates the provisions of this subsection in the following calendar year, then the commission shall revoke such supplier's certification.

2. The public service commission shall develop standards for certification of natural gas suppliers consistent with this section on or before December 1, 2001. No rule or portion of a rule promulgated pursuant to this section shall take effect unless such rule has been promulgated pursuant to chapter 536, RSMo.
