AN ACT
To amend chapter 163, RSMo, by adding thereto one new section relating to state aid for education of students with limited English proficiency.
Section A. Chapter 163, RSMo, is amended by adding thereto one new section, to be known as section 163.074, to read as follows:
163.074. 1. As used in this section, the following words and phrases mean:
(1) "Language minority", having a linguistic background, including country of birth or home environment, which includes languages other than English;
(2) "Limited English proficient" or "LEP", any language minority student whose English language proficiency is below that of grade and age level peers.
2. Any school district which enrolls one or more limited English proficient pupils shall receive state aid for the
ensuing year as provided pursuant to this section. A district shall receive, pursuant to this section, subject to
appropriation, an amount equal to seven hundred dollars per enrolled, LEP pupil. If annual appropriations are
insufficient to fully fund all payments provided for pursuant to this subsection, the per pupil amount shall be
uniformly prorated for all such payments to the extent necessary to ensure that the total of the prorated payments
equals the funds appropriated.
