AN ACT
To amend chapter 537, RSMo, by adding thereto one new section relating to insurance coverage for punitive damages.
Section A. Chapter 537, RSMo, is amended by adding thereto one new section, to be known as section 537.530, to read as follows:
537.530. It is the public policy of this state to permit the solicitation, sale, issuance or delivery of liability insurance
policies to individuals or business entities providing coverage indemnifying individuals or business entities against
liability for punitive damages which is imposed under principles of vicarious liability or respondeat superior
liability; except when such punitive damages are imposed as a result of the direct participation in or express
authorization by the individuals or business entities being indemnified of the culpable conduct committed by agents,
servants, or employees expected or intended to cause injury or harm to another.
