AN ACT

To amend chapter 136, RSMo, by adding thereto one new section relating to donation of article X refunds to the state.



Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 136, RSMo, is amended by adding thereto one new section, to be known as section 136.406, to read as follows:

136.406. The department of revenue shall develop a program that allows any taxpayer eligible to receive a refund of excess revenues pursuant to section 18 of article X of the Missouri Constitution to donate such refund, in whole or in part, to any existing fund in the state treasury prior to receipt of such refund. The department of revenue shall promulgate all rules and regulations necessary to implement the donation program authorized by this section. No rule or portion of a rule promulgated pursuant to the authority of this section shall become effective unless it has been promulgated pursuant to the provisions of chapter 536, RSMo.
