HB 1768 -- JUDGMENT LIENS ON REAL ESTATE
CO-SPONSORS: Hosmer, Smith
COMMITTEE ACTION: Voted "do pass by consent" by the Committee on
Civil and Administrative Law by a vote of 13 to 0.
This bill provides that judgment liens on real estate will
continue for 10 years if the judgment was entered after August
28, 1998; the lien of judgments entered prior to that date
continues for three years.
FISCAL NOTE: No impact on state funds.
PROPONENTS: Supporters say that the bill is needed to clarify a
change made in the law last year. A bill enacted last year
increased the life of judgment liens from three years to 10 years
but it was not clear as to whether it affected liens that were
created during the three years prior to the effective date of the
bill. The bill merely clarifies that last year's bill does not
affect liens in existence before August 28, 2001.
Testifying for the bill were Representative Hosmer; and Missouri
Land Title Association.
OPPONENTS: There was no opposition voiced to the committee.
