HB 1168 -- Modification of Child Custody

This bill revises a provision pertaining to the modification of a
prior child custody decree.

Currently, the court can modify a prior custody decree in
compliance with Section 452.450, RSMo, and upon the finding of
new facts which have arisen or were unknown to the court prior to
the time of the original decree that result in a change in the
circumstances of the child or the child's custodian.

The bill requires that a substantial and continuing change occur
in the circumstances of the child or the child's custodian and
that modification of the original custody decree will serve the
best interests of the child.
