Summary of the Introduced Bill

HB 2003 -- Long-Term Care

Co-Sponsors:  Harlan, Ladd Baker, Hosmer

This bill makes several changes in the law relating to long-term
care facilities.  In its major provisions, the bill:

(1)  Requires the Department of Health and Senior Services to
hire and administratively supervise clerical and administrative
support staff for the Missouri Health Facilities Review
Committee;

(2)  Extends from January 1, 2003, to January 1, 2005, the
moratorium on issuing a certificate of need for additional
long-care beds (Section 197.317, RSMo);

(3)  Extends until January 1, 2005, a minimum expenditure of zero
under Section 197.318;

(4)  Requires health facilities to notify the Health Facilities
Review Committee of the number of licensed beds in the facility
that are unavailable on an annual basis and requires the
committee to collect a surcharge of $1,000 per each licensed and
unavailable bed beginning January 1, 2003;

(5)  Revises the conditions under which an individual can be
accepted to live in a residential care facility I or residential
care facility II;

(6)  Allows a residential care facility II to admit or continue
to care for patients with dementia who require assistance in
order to evacuate in the case of an emergency under specified
conditions;

(7)  Requires facilities to comply with certain training
requirements;

(8)  Requires the departments of Health and Senior Services,
Social Services, Mental Health, and Elementary and Secondary
Education to compare their assessment procedures for individuals
who receive long-term care services and work together to make
changes in these procedures;

(9)  Specifies what must be included in the assessment procedures
for individuals with long-term care needs;

(10)  Requires the departments and volunteers to work together to
evaluate persons receiving public assistance in long-term care
facilities and determine their desire and ability to move out of
the institution and into a community setting;

(11)  Divides the existing class I standards for nursing homes
into three separate classes for death violations, harm
violations, and risk violations;

(12)  Requires the Department of Health and Senior Services to
license a new type of facility, known as a "Health Care Facility
for Persons with Alzheimer's Disease or Alzheimer's Related
Dementia," to which the certificate of need requirements do not
apply;

(13)  Requires licensed nursing homes that receive Medicaid
funding to submit an annual financial statement by October 15 of
each year to the department for the purpose of developing an
annual report for the General Assembly and specifies the
information to be included in the financial statement;

(14)  Requires the Department of Social Services to use the same
age restrictions, division of assets, and income allowances to
determine Medicaid eligibility and benefits for individuals
eligible to receive services through a home- and community-based
waiver as are used to determine eligibility and benefits for
individuals who require institutional care;

(15)  Requires the Department of Health and Senior Services to
investigate reports of elder abuse and neglect and to refer all
suspected cases of elder abuse to the appropriate law enforcement
agency and prosecuting attorney; and

(16)  Adds persons who employ individuals who provide personal
care assistance services to the list of persons who are required
to go through a criminal history check.
