AN ACT
To amend chapter 565, RSMo, by adding thereto one new section relating to the crime of tampering with pharmaceuticals, with a penalty provision.
Section A. Chapter 565, RSMo, is amended by adding thereto one new section, to be known as section 565.350, to read as follows:
565.350. 1. A person commits the crime of tampering with pharmaceuticals if such person intentionally:
(1) Dilutes a pharmaceutical from the concentration prescribed without the knowledge and consent of the individual who prescribed such pharmaceutical, and dispenses such pharmaceutical with the knowledge that the dilution may impair the effectiveness of the pharmaceutical; or
(2) Misrepresents a diluted pharmaceutical as an undiluted pharmaceutical with the purpose of misleading the recipient or person administering such pharmaceutical.
2. Tampering with pharmaceuticals is a class B felony, unless death or serious physical injury occurs as a result of
such tampering, in which case the offense is a class A felony.
