AN ACT

To amend chapter 338, RSMo, by adding thereto one new section relating to pharmacies.



Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 338, RSMo, is amended by adding thereto one new section, to be known as section 338.097, to read as follows:

338.097. 1. Every pharmacy licensed by the board of pharmacy pursuant to this chapter shall, within ten days of discovery, notify the board of any mistake in a prescription made by such pharmacy.

2. If a pharmacy is named as a defendant in a court action involving a mistaken prescription, such action shall be subject to review by the board. Within ten days of final disposition in such action, the pharmacy named as a defendant shall notify the board of the action. Following a review of the court action, the board may provide additional training to the pharmacy to reduce the risk of future mistakes in prescriptions.
