AN ACT
To amend chapter 338, RSMo, by adding thereto one new section relating to pharmacies.
Section A. Chapter 338, RSMo, is amended by adding thereto one new section, to be known as section 338.097, to read as follows:
338.097. 1. Every pharmacy licensed by the board of pharmacy pursuant to this chapter shall, within ten days of discovery, notify the board of any mistake in a prescription made by such pharmacy.
2. If a pharmacy is named as a defendant in a court action involving a mistaken prescription, such action shall be
subject to review by the board. Within ten days of final disposition in such action, the pharmacy named as a
defendant shall notify the board of the action. Following a review of the court action, the board may provide
additional training to the pharmacy to reduce the risk of future mistakes in prescriptions.
