AN ACT

To amend chapter 414, RSMo, by adding thereto one new section relating to alternative fuels.



Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 414, RSMo, is amended by adding thereto one new section, to be known as section 414.365, to read as follows:

414.365. 1. On or before July 1, 2004, the Missouri department of transportation shall develop and implement a program that provides for the use of alternative fuels with a two percent biodiesel blend in its vehicle fleet and heavy equipment that use diesel fuel. This program shall be implemented with the following goals:

(1) On or before July 1, 2004, at least fifty percent of the department's vehicle fleet and heavy equipment that use diesel fuel shall use alternative fuel with a two percent biodiesel blend, if possible;

(2) On or before July 1, 2005, at least seventy-five percent of the department's vehicle fleet and heavy equipment that use diesel fuel shall use alternative fuel with a two percent biodiesel blend, if possible.

2. The director of the Missouri department of transportation may promulgate any rules necessary to carry out the provisions of this section. No rule or portion of a rule promulgated pursuant to this section shall take effect unless it has been promulgated pursuant to chapter 536, RSMo.
