AN ACT
To repeal section 192.323, RSMo, and to enact in lieu thereof one new section relating to the health document services fund.
Section A. Section 192.323, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 192.323, to read as follows:
192.323. 1. The "Department of Health and Senior Services Document Services Fund" is hereby created. All funds received by the department of health and senior services from the fees charged for reports, studies, records and other publications and documents including data tapes and audiovisual products produced or reproduced by the department shall be credited to the fund. The director of the department shall administer the fund. The state treasurer is the custodian of the fund and shall approve disbursements from the fund requested by the director of the department. When appropriated by the general assembly, moneys from the fund shall be used to [purchase goods or services that will ultimately be used for the following purposes only] pay costs, including personnel costs, as follows:
(1) To pay costs associated with the collection, processing, storage, and access to documents and data;
(2) To produce publications or other documents including data tapes and audiovisual products requested by governmental agencies or members of the general public;
[(2)] (3) To publish the publications or other documents or to purchase reports, publications or other documents including data tapes and audiovisual products for reproduction; and
[(3)] (4) To pay shipping charges.
2. An unexpended balance in the fund at the end of the fiscal year not exceeding fifty thousand dollars is exempt from the
provisions of section 33.080, RSMo, relating to the transfer of unexpended balances to the general revenue
fund.
