HB 505 -- MERCHANDISING PRACTICES CO-SPONSORS: Byrd, Villa COMMITTEE ACTION: Voted "do pass by consent" by the Committee on Transportation and Motor Vehicles by a vote of 18 to 0. This bill prohibits rental companies from collecting more on claims for damages to or loss of rental vehicles than the actual cost of repair or the actual cash value less salvage or disposal proceeds. The bill also permits the claim to be based upon a repair invoice prepared by a repair facility. FISCAL NOTE: No impact on state funds. PROPONENTS: Supporters say prohibiting rental companies from collecting more on claims for damages to or loss of rental vehicles than the actual cost of repair or the actual cash value less salvage or disposal proceeds is only a fair business practice.
