HB 33 -- Licensure of Homes for Children

Current law exempts the following facilities for children from
licensure by the Division of Family Services:

(1)  Residential care facilities providing tuition-based
educational programs which meet criteria recognized by the
Department of Elementary and Secondary Education;

(2)  Camps, sanitariums, or homes providing recreational, medical
treatment, or nursing care; and

(3)  Foster home arrangements, residential care facilities, or
child placing agencies established and operated by well-known
religious orders.

This bill repeals the exemptions.

Current law also prohibits the division from requiring facilities
that believe they are exempt to submit documentation in support
of exemption.  The bill repeals that prohibition.
