HB 561 -- Design-Build Contracts

This bill authorizes design-build contracts in certain instances.
The bill:

(1)  Allows the Director of the Division of Design and
Construction to determine whether a design-build procurement
process is necessary for certain projects;

(2)  Authorizes the division to contract with consultants for the
purposes of preparing proposals, reviewing documents, resolving
disputes, and making inspections;

(3)  Creates an evaluation team within the division for the
purpose of reviewing design-build proposals;

(4)  Develops a three-phase process in which proposals may be
solicited.  The first phase involves the soliciting of qualified
design builders, phase two narrows the field of qualified design
builders, and phase three is the bid submission; and

(5)  Requires the division to reimburse unsuccessful bidders for
costs incurred during the proposal submission process.

The provisions of the bill expire December 31, 2005.
