HB 704 -- Certificate of Need Revolving Fund

This bill establishes the Certificate of Need Revolving Fund in
the state treasury.  The Health Facilities Review Committee is
required to administer the fund.

Effective January 1, 2004, all application fees and other fees
received by the committee will be deposited into the fund.  From
August 28, 2003, to December 31, 2003, all application fees and
other fees received by the committee will be deposited into a
dedicated temporary fund established in the state treasury.
Moneys in the dedicated temporary fund will be administered for
the same purposes as the revolving fund.  Any moneys remaining in
the dedicated temporary fund after December 31, 2003, will be
transferred to the revolving fund, and the temporary fund will be
dissolved.

The bill requires the State Treasurer to be the custodian of the
fund and to approve disbursements from the fund as requested by
the committee.  Appropriated moneys in the revolving fund will be
used for the payment of all costs and expenses incurred in the
Certificate of Need Program.  After January 1, 2004, no
appropriations from general revenue will be made by the General
Assembly to the fund unless costs and expenses exceed the revenue
generated by the fees.

Any unencumbered balance in the fund at the end of the fiscal
year under $400,000 will not revert to general revenue.  The
committee is required to annually report all moneys deposited in
and expenditures from the revolving fund to the House Budget
Committee and the Senate Appropriations Committee.
