AN ACT

To amend chapter 226, RSMo, by adding thereto one new section relating to the state highways and transportation department fund.





Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 226, RSMo, is amended by adding thereto one new section, to be known as section 226.202, to read as follows:

            226.202. 1. There is hereby created a subaccount within the state highways and transportation department fund created pursuant to section 226.200. The subaccount shall consist of any moneys appropriated by the general assembly, and any gifts, contributions, grants, or bequests received from federal, private, or other sources. Subject to appropriation, moneys in the subaccount shall be used solely for the purpose of paying a seventy-five dollar fee to any tow truck service that removes an abandoned vehicle from a roadway or side of a roadway within this state at the request of a law enforcement agency subject to the requirements set forth in subsection 2 of this section. The subaccount shall be administered by the department of transportation.

            2. In order to be eligible to receive the seventy-five dollar fee, a tow truck service shall hold the vehicle they removed at the request of a law enforcement agency for at least thirty days prior to receiving the fee. If the owner of the motor vehicle claims the vehicle the tow truck service removed after the tow truck service has already received the seventy-five dollar fee, the tow truck service shall return the entire seventy-five dollar fee along with a twenty-five dollar service fee to the subaccount. If a tow truck service applies for and receives a title to the towed vehicle and sells the vehicle, the tow truck service shall return the seventy-five dollar fee along with a twenty-five dollar service fee to the subaccount. The tow truck service shall be permitted to retain the remainder of the proceeds from the sale of such vehicle.

            3. The state treasurer shall invest moneys in the subaccount in the same manner as other funds are invested. Interest and moneys earned on such investments shall be credited to the subaccount. Any balance remaining in the subaccount at the end of the fiscal year and after payment of all fees pursuant to this section shall be transferred to the state road fund as required by section 226.200.
