AN ACT

To amend chapter 565, RSMo, by adding thereto one new section relating to assault of a Missouri sexual offender treatment center or department of corrections employee, with a penalty provision.





Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 565, RSMo, is amended by adding thereto one new section, to be known as section 565.077, to read as follows:

            565.077. 1. A person commits the crime of assault of a Missouri sexual offender treatment center or department of corrections employee if he or she attempts to kill or knowingly causes or attempts to cause serious physical injury to such employee while such employee is engaged in the performance of a duty imposed by statute or administrative rule.

            2. Assault of a Missouri sexual offender treatment center or department of corrections employee is a felony for which the authorized term of imprisonment is a term of years not less than ten nor more than twenty years, without eligibility for probation, parole, discharge, work release or supervised release, except by act of the governor.
