AN ACT

To amend chapters 43 and 301, RSMo, by adding thereto two new sections relating to the creation of the highway patrol's trust fund, with an emergency clause.





Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapters 43 and 301, RSMo, are amended by adding thereto two new sections, to be known as sections 43.300 and 301.047, to read as follows:

            43.300. There is hereby created in the state treasury the "Highway Patrol's Trust Fund", which shall be administered by the superintendent of the highway patrol. All funds received by the highway patrol from any dedicated source of fees, taxes, or surcharges shall be credited to the fund. The state treasurer is the custodian of the fund and shall approve disbursements from the fund subject to appropriation and as provided by law and the constitution of this state at the request of the superintendent of the highway patrol. Any deposits to the fund shall not reduce or offset any current or future appropriation. Any unexpended balance remaining in the fund at the end of the fiscal year shall not be transferred to the general revenue fund pursuant to section 33.080, RSMo. All unexpended money in the fund shall remain in the fund and the balance shall be kept in the fund to accumulate year to year.

            301.047. Beginning July 1, 2003, a five dollar surcharge shall be imposed on each motor vehicle or trailer license sold, renewed, or transferred on an annual basis. A ten dollar surcharge shall be imposed on those licenses sold or renewed biennially pursuant to section 301.147. The proceeds generated from such surcharges shall be credited to the highway patrol trust fund established pursuant to section 43.300, RSMo.

            Section B. Because of the need to fund certain projects in the highway patrol, section A of this act is deemed necessary for the immediate preservation of the public health, welfare, peace and safety, and is hereby declared to be an emergency act within the meaning of the constitution, and section A of this act shall be in full force and effect on July 1, 2003, or upon its passage and approval, whichever later occurs.
