AN ACT

To amend chapter 174, RSMo, by adding thereto one new section relating to meningitis vaccinations in institutions of higher education.





Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 174, RSMo, is amended by adding thereto one new section, to be known as section 174.133, to read as follows:

            174.133. 1. Beginning with the 2004-2005 school year and for each school year thereafter, every public and private institution of higher education in this state shall require all students who reside in on-campus housing to be vaccinated against meningococcal disease as a condition of residence in on-campus housing.

            2. This section shall not apply to a student if:

            (1) The institution of higher education provides the student or if the student is a minor, the student's parents or guardian with detailed written information on the risks associated with meningococcal disease and the availability and effectiveness of the meningococcal vaccine; and

            (2) After reviewing the written information provided in subdivision (1) of this subsection, the student or if the student is a minor, one of the student's parents or guardian signs a written waiver stating that the written information in subdivision (1) of this subsection was provided and reviewed, and the student has chosen not to be vaccinated against meningococcal disease.

            3. Each public and private university or college in this state shall maintain records on the meningococcal vaccination status of every student residing in on-campus housing at the university or college, including any written waivers executed pursuant to subsection 2 of this section.

            4. Nothing in this section shall be construed as requiring any institution of higher education to provide or pay for vaccinations against meningococcal disease.
