AN ACT
To amend chapter 28, RSMo, by adding thereto one new section relating to the collection of fees by the secretary of state.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 28, RSMo, is amended by adding thereto one new section, to be known as section 28.175, to read as follows:
28.175. 1. For all fees collected by the secretary of state, the secretary of state may enter into contracts with private attorneys or professional collection agencies for the collection of delinquent fees owed by residents or nonresidents of the state of Missouri; except that, any contract let pursuant to this section shall be awarded in the manner prescribed by chapter 34, RSMo, and shall be subject to appropriations for that purpose as provided by law. Any contract entered into pursuant to this section shall not provide for a collection fee in excess of twenty-five percent of the amount collected.
2. Bad debt, defined for purposes of this subsection as the difference between the amount expected to be received and the amount actually received, may be written off by the secretary of state as uncollectible after reasonable collection efforts are exhausted. Collection efforts shall be documented. The secretary of state shall develop and maintain written procedures detailing how, when, and by whom a receivable may be written off as a bad debt.
