HB 1575 -- REPUBLICATION OF SECTIONS IN STATUTE SPONSOR: Rector (Mayer) COMMITTEE ACTION: Voted "do pass by consent" by the Committee on Communications, Energy and Technology by a vote of 20 to 0. This bill reenacts two sections of law regarding the sale of motor fuel below cost. In 1995, House Bill 414 amended these sections; however, it was found to be in violation of the single subject requirement of Article III, Section 23, of the Missouri Constitution. Since that time, the sections have appeared in statute but have not been enforceable. The bill will republish these sections allowing them to be enforced. FISCAL NOTE: No impact on state funds in FY 2005, FY 2006, and FY 2007. PROPONENTS: Supporters say that the bill is necessary in order to republish two sections of law that relate to the sale of motor fuel below cost. The bill will not change current law. These sections were included in a bill that was later found to violate the single subject provision of the Missouri Constitution. The court does not have the authority to require the reprinting of statutes. That authority is given to the General Assembly.
