Summary of the Committee Version of the Bill

HB 1616 -- ADMINISTRATIVE RULES

SPONSOR:  Hanaway

COMMITTEE ACTION:  Voted "do pass" by the Committee on Judiciary
by a vote of 14 to 3.

This bill allows the Secretary of State to prescribe the format
and medium for publication of the Missouri Register; the Code of
State Regulations; and all rules, notices of proposed rulemaking,
and orders of rulemaking.  Publication in writing will be
available upon request.

Under current law, new language in notices of proposed rulemaking
may either be underlined or printed in boldface type.  The bill
eliminates that option and requires the bolding of new language.

Rules, regulations, standards, and guidelines of any agency of
the United States or a nationally or state-recognized
organization or association may be incorporated by reference in
agency rules by state agencies without publishing the information
in full.  The reference must be sufficient to determine where to
obtain copies of the referenced material.  A full copy of the
rule, regulation, standard, or guideline must be maintained by
the agency referencing it and must be available for public
inspection and copying at no more than the actual cost of
reproduction.

FISCAL NOTE:  Estimated Net Income on General Revenue Fund of
$40,000 to Unknown in FY 2005, FY 2006, and FY 2007.  No impact
on Other State Funds in FY 2005, FY 2006, and FY 2007.

PROPONENTS:  Supporters say that the bill will facilitate the
dissemination of information and will save the Secretary of
State's Office money.

Testifying for the bill were Representatives Hanaway and Byrd;
and Office of Secretary of State.

OPPONENTS:  There was no opposition voiced to the committee.
