HB 1169 -- Higher Education Use of Social Security Numbers Sponsor: Luetkemeyer This bill delineates the conditions under which a public higher education institution may require the use of an individual's Social Security number. Beginning July 1, 2006, these numbers cannot be: (1) Posted publicly; (2) Transmitted over the Internet unless the connection is secure or the number encrypted; (3) Required as an access code unless an additional authentication device is required; (4) Printed on documents mailed to an individual unless required by law; or (5) Used on a student identification card. Institutions that have been using Social Security numbers in any of the prohibited ways prior to July 1, 2006, may continue the use if annual disclosure is made and the individual given the right to stop the use. Written requests to stop the use of the numbers must be acted upon within 30 days of the request. The bill does not affect use or release of Social Security numbers as required by federal or other state law or their use for internal administrative purposes. The bill does not apply to documents that are recorded or required to be open under the public records law or to records required by case law or court rules to be available to the public. If a federal patient health identifier program is enacted, compliance with the federal law would be considered compliance with the bill.
