HB 1262 -- Publicly Financed Projects

This bill prohibits an employer from employing or subcontracting
with an illegal alien on any publicly financed project.
Effective August 28, 2004, in addition to any other penalty,
employers in violation of this provision are to be fined $10 per
alien per day.  The employer will be ineligible to bid on any
publicly financed project for 10 years.

Current law requires employers contracting for construction or
renovation projects with any public entity, during times of
excessive unemployment, to hire Missouri laborers and laborers
from nonrestrictive states.  The employer may hire laborers other
than Missouri laborers or unrestrictive state laborers if the
laborers are unavailable or unqualified for preforming the work
required.  The bill requires that employers in violation forfeit
$10 per unqualified worker per day to the public entity with whom
they are under contract.  The public entity is to withhold all
amounts due as a result of the violation.
