Summary of the Introduced Bill

HB 857 -- Toll Roads

This bill enables the Highways and Transportation Commission to
fund, construct, and operate toll roads, toll bridges, and other
toll facilities connected with toll roads and bridges.  It is
contingent upon the approval of a constitutional amendment
authorizing the commission to fund, construct, and operate toll
facilities.

The bill creates a State Toll Facility Fund which will stand
appropriated for the purpose of receiving and expending funds in
connection with the operation of toll facilities.

The commission is authorized to issue revenue bonds, establish
bonding procedures, establish separate reserve funds and escrow
accounts, and transfer moneys between various funds for the
operation of toll facilities.

The bill establishes procedures and methods for toll collection,
enforcement, and penalties and fines for nonpayment of tolls.

Several specific highway and bridge projects are authorized in
the bill for state toll facility projects.  The commission will
be allowed to construct toll facility projects using the design-
build project delivery system.

A toll facility may be designated by the commission as a part of
the national highway system for purposes of outdoor advertising
and junkyard control.
