AN ACT

To amend chapter 84, RSMo, by adding thereto one new section relating to police personnel records.





Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 84, RSMo, is amended by adding thereto one new section, to be known as section 84.123, to read as follows:

            84.123. 1. Any police department in any county with a charter form of government and with more than one million inhabitants shall, prior to hiring a police officer, request the personnel records of such police officer from any other law enforcement agency for whom such police officer has worked as a peace officer within the last twelve months and shall not hire such police officer until such personnel records have been received and reviewed.

            2. Any law enforcement agency that receives a request for peace officer personnel records pursuant to subsection 1 of this section shall respond to such request within five business days of receiving the request. Notwithstanding any other provision of law, law enforcement agencies may report or disclose peace officer personnel records to any police department which has requested such peace officer personnel records pursuant to subsection 1 of this section.
