AN ACT
To amend chapter 389, RSMo, by adding thereto one new section relating to injured railroad employees, with a penalty provision.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 389, RSMo, is amended by adding thereto one new section, to be known as section 389.798, to read as follows:
389.798. 1. Notwithstanding any other provision of law it shall be unlawful for a railroad corporation as defined in section 388.010, RSMo, or an employee of such railroad corporation to:
(1) Deny, delay, or interfere with medical treatment or first-aid treatment to an employee of a railroad corporation who has been injured during employment; or
(2) Discipline or threaten discipline to an employee of a railroad corporation who has been injured during employment for requesting medical treatment or first-aid treatment for such injury.
2. Any railroad corporation or employee of a railroad corporation who violates the provisions of subsection 1 of this section shall be imprisoned for a term of years not to exceed two years and fined in an amount not to exceed ten thousand dollars for each violation.
