AN ACT
To amend chapter 304, RSMo, by adding thereto one new section relating to the display of adult entertainment films in motor vehicles, with a penalty provision.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 304, RSMo, is amended by adding thereto one new section, to be known as section 304.800, to read as follows:
304.800. 1. As used in this section, the following terms mean:
(1) "Adult entertainment film", any magnetic or electronic recording, production, or reproduction of any motion picture film, videotape, digital video disk, or any similar device, depicting human actual or simulated sexually explicit conduct;
(2) "Sexually explicit conduct":
(a) Sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex;
(b) Deviate sexual intercourse, as defined in section 556.010, RSMo;
(c) Bestiality;
(d) Masturbation;
(e) Sadistic or masochistic abuse;
(f) Lascivious exhibition or depiction of any human postpubertal genitals or pubic area; or
(g) Direct physical stimulation of unclothed genitals.
2. No person operating or driving any motor vehicle on any road or highway in this state shall display or allow the display of any adult entertainment film on any video player, digital video disk player, or similar device within the vehicle in such a manner that any child under the age of eighteen in the person's vehicle or in another vehicle on the road or highway is able to view any part of the film.
3. Violation of this section is a class D felony.
