AN ACT
To amend chapter 407, RSMo, by adding thereto one new section relating to the telemarketing no-call list.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 407, RSMo, is amended by adding thereto one new section, to be known as section 407.1096, to read as follows:
407.1096. 1. Beginning January 1, 2005, the prohibition on telephone solicitations and all applicable procedures and penalties in sections 407.1095 to 407.1110, and any applicable rules and regulations promulgated under sections 407.1095 to 407.1110, shall apply to fax transmissions to the telephone number of any residential subscriber in this state who has given notice to the attorney general, in accordance with rules promulgated under this section, of such subscriber's objection to receiving fax transmissions.
2. The attorney general shall establish and provide for the operation of a database to compile a list of telephone numbers of residential subscribers who object to receiving such fax transmissions. The attorney general shall have the database in operation no later than January 1, 2005.
3. The attorney general may promulgate rules and regulations necessary to administer this section. No rule or portion of a rule promulgated pursuant to the authority of this section shall become effective unless it has been promulgated pursuant to chapter 536, RSMo.
