AN ACT
To amend chapter 247, RSMo, by adding thereto one new section relating to public water supply districts.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 247, RSMo, is amended by adding thereto one new section, to be known as section 247.173, to read as follows:
247.173. Notwithstanding other provisions of law to the contrary, the service provided or made available through any public water supply district shall be exclusive and shall not be curtailed or limited by inclusion of area served by the public water supply district within the boundaries of any municipal corporation or other public body, or by inclusion of area served by the public water supply district within the service territory of a municipal corporation providing water service beyond its boundaries, or by the granting of any private franchise for similar service within such area served during the term of any general or special obligation bonds of the district or of any contractual obligations of the district greater than twenty-five thousand dollars for debt that pertains to infrastructure, fixed assets, or obligations for the purchase of water, nor shall the occurrence of any such event be the basis for requiring a public water supply district to secure any franchise, license, or permit as a condition to continuing to serve the area served by such district at the time of the occurrence of such event. For purposes of this section, "service provided or made available" and "area served" means that such district is providing water service within the area or that it has adequate facilities within or adjacent to the area to provide water service to the area within a reasonable time after a request for service is made.
