AN ACT

To amend chapter 643, RSMo, by adding thereto one new section relating to mercury emission.





Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 643, RSMo, is amended by adding thereto one new section, to be known as section 643.640, to read as follows:

            643.640. 1. As used in this section the following terms mean:

            (1) "Department", the department of natural resources of the state of Missouri;

            (2) "Person", any individual, partnership, copartnership, firm, company, or public or private corporation, association, joint stock company, trust, estate, political subdivision, or any agency, board, department, or bureau of the state or federal government, or any other legal entity that is recognized by law as the subject of rights and duties.

            2. Any person who is required to file an annual emissions inventory questionnaire and who emits thirty or more pounds of mercury per year shall pay to the department's air pollution control program a fee of one thousand dollars per pound for every pound of mercury emitted.

            3. The air pollution control program shall retain only the amount of revenue from fees paid under subsection 2 of this section as is necessary for the program to oversee the collection and allocation of the revenue. All other revenue from the fees paid under subsection 2 of this section shall be allocated to the bureau of special health care needs of the division of maternal, child, and family health.
