AN ACT

To amend chapter 173, RSMo, by adding thereto four new sections relating to scholarships for community college students and graduates.





Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 173, RSMo, is amended by adding thereto four new sections, to be known as sections 173.272, 173.273, 173.274, and 1, to read as follows:

            173.272. 1. The coordinating board for higher education shall establish an "All State Academic Team Scholarship Program", and any moneys appropriated by the general assembly for this program shall be used by the board to provide scholarships for citizens of this state to transfer from a community college to a public four-year Missouri college or university of their choice pursuant to the provisions of this section.

            2. The definitions of terms set forth in section 173.025 shall be applicable to such terms as used in this section.

            3. The coordinating board for higher education shall:

            (1) Promulgate rules to implement the provisions of this section;

            (2) Prescribe the form and the time and method of awarding the scholarships, and shall supervise the processing thereof; and

            (3) Select qualified recipients to receive the scholarships, make such awards of scholarships to qualified recipients, and determine the manner and method of payment to the recipients. 

            4. A student shall be eligible for an all state academic team scholarship if, at the time of his or her application, the student:

            (1) Is a Missouri citizen;

            (2) Has been selected as a member of the All-Missouri Academic Team; and

            (3) Is a current community college student or a recent graduate of a community college.

            5. A scholarship under this section shall, upon the student's transfer from a community college of this state, cover tuition and textbooks at a four-year public educational institution of this state for a total of seventy credit hours which shall be completed within ten years of transferring from the community college.

            6. Any rule or portion of a rule, as that term is defined in section 536.010, RSMo, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and if any of the powers vested with the general assembly pursuant to chapter 536, RSMo, to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2004, shall be invalid and void.

            173.273. 1. The coordinating board for higher education shall establish a "Community College Honors Scholarship Program", and any moneys appropriated by the general assembly for this program shall be used by the board to provide scholarships for Missouri citizens to attend a Missouri community college of their choice pursuant to the provisions of this section.

            2. The definitions of terms set forth in section 173.025 shall be applicable to such terms as used in this section.

            3. The coordinating board for higher education shall:

            (1) Promulgate rules to implement the provisions of this section;

            (2) Prescribe the form and the time and method of awarding the scholarships, and shall supervise the processing thereof; and

            (3) Select qualified recipients to receive the scholarships, make such awards of scholarships to qualified recipients, and determine the manner and method of payment to the recipients. 

            4. A student shall be eligible for a community college honors scholarship if, at the time of his or her application, the student:

            (1) Is a Missouri citizen; and

            (2) Is a recent honors graduate from an accredited high school of this state, graduating with a grade point average of 3.5 or higher, and an ACT or SAT score to be determined by the coordinating board for higher education; or

            (3) Is a current community college student who has obtained a cumulative grade point average of 3.5 or higher after completing his or her first twelve credit hours.

            5. A scholarship under this section shall cover tuition and books for a maximum of seventy credit hours at a community college of this state, which shall be completed within ten years of qualification for the community college honors scholarship.

            6. Any rule or portion of a rule, as that term is defined in section 536.010, RSMo, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo.             173.274. 1. By August 28, 2012, the coordinating board for higher education shall establish a "Community College Honors Graduate Scholarship Program" for which every student graduating from a community college after such date with a cumulative grade point average of 3.0 or higher shall be eligible. Any moneys appropriated by the general assembly for this program shall be used to provide scholarships for Missouri citizens who transfer after completion of an associates degree program at a community college of this state to a public four-year Missouri college or university of their choice pursuant to the provisions of this section.

            2. The definitions of terms set forth in section 173.025 shall be applicable to such terms as used in this section.

            3. The coordinating board for higher education shall:

            (1) Promulgate rules to implement the provisions of this section;

            (2) Prescribe the form and the time and method of awarding the scholarships, and shall supervise the processing thereof; and

            (3) Select qualified recipients to receive the scholarships, make such awards of scholarships to qualified recipients, and determine the manner and method of payment to the recipients. 

            4. A student shall be eligible for a community college honors graduate scholarship if, at the time of his or her application, the student:

            (1) Is a Missouri citizen; and

            (2) Has recently graduated from a community college of this state with a cumulative grade point average of 3.0 or higher.

            5. A scholarship under this section shall, upon transfer from a community college of this state, cover tuition at a four-year public institution for a total of seventy credit hours; such credit hours shall be completed within ten years of graduation from a community college of this state.

            6. Any rule or portion of a rule, as that term is defined in section 536.010, RSMo, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and if any of the powers vested with the general assembly pursuant to chapter 536, RSMo, to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2004, shall be invalid and void.

            7. The provisions of this section shall become effective January 1, 2012.

            Section 1. Pursuant to section 23.253, RSMo, of the Missouri Sunset Act:

            (1) The provisions of the new program authorized under sections 173.272, 173.273, and 173.274 shall automatically sunset six years after the effective date of sections 173.272, 173.273, and 173.274 unless reauthorized by an act of the general assembly; and

            (2) If such program is reauthorized, the program authorized under sections 173.272, 173.273, and 173.274 shall automatically sunset twelve years after the effective date of the reauthorization of sections 173.272, 173.273, and 173.274; and

            (3) Sections 173.272, 173.273, and 173.274 shall terminate on September first of the calendar year immediately following the calendar year in which the program authorized under sections 173.272, 173.273, and 173.274 is sunset.
