JOINT RESOLUTION
Submitting to the qualified voters of Missouri an amendment repealing section 39(f) of article III of the Constitution of Missouri, and adopting one new section in lieu thereof relating to gaming.
Be it resolved by the House of Representatives, the Senate concurring therein:
That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 2004, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article III of the Constitution of the state of Missouri:
Section A. Section 39(f), article III, Constitution of Missouri, is repealed and one new section adopted in lieu thereof, to be known as section 39(f), to read as follows:
Section 39(f). Any organization recognized as charitable or religious pursuant to federal law may sponsor raffles [and], sweepstakes, and the use of gaming devices in which a person risks something of value for a prize. Such gaming devices shall only be used on the premises of a nonprofit veterans' organization and only by members in good standing of that organization, with an annual license fee of five hundred dollars per organization and with a limit of no more than one gaming device per seventy-five members in good standing of such organization; provided, however, that the license fee and gaming device limit may be otherwise as provided by law. Notwithstanding the provisions of section 39(d) of this article to the contrary, state revenue derived from the use of such gaming devices shall only be appropriated for veterans' benefits and organizations. The general assembly may, by law, provide standards and conditions to regulate or guarantee the awarding of prizes provided for in such raffles or sweepstakes or by the use of such gaming devices.
